If so, then you\u2019re in the minority. FMCSA data shows that only six percent of carriers have gotten through an audit or inspection without a violation in 2019. That means that 94% of audits and roadside inspections have resulted in at least one violation. And with an average fine amount of $7,109 so far this year, these fines can have a serious financial impact on motor carriers\u2014as well as their CSA scores.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">                                                         <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Further complicating the issue is the nationwide rollout of\noffsite audits this year, which is gradually replacing the traditional onsite\naudit process \u2013 and requiring motor carriers to be even more audit ready then\nthey\u2019ve been in the past. If you\u2019re not yet familiar with the process, it works\nlike this: instead of a DOT auditor showing up at your place of business to\nreview your compliance programs, an auditor will contact you via phone and\/or\nemail and request that you send proof of your compliance to them\nelectronically. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This could include a list of drivers, proof that drivers are\nenrolled in a drug and alcohol testing program and forms from your driver\nqualification files. With less preparation time than onsite audits, as well as\nthe need to have all documents available to send in an electronic format, it\u2019s\nbecoming more and more important for motor carriers to have a system in place\nthat keeps them fully compliant. As we\u2019ll discuss later, making the switch from\na paper to a digital system can also be very beneficial, as it will ensure all\nyour documents are complete and audit ready when an auditor comes calling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What You Need to Know<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are specific paperwork requirements you must adhere\nto. Even during an offsite audit, you will be required to produce certain\ndocuments to prove your compliance in the required areas. Here are the items\nyou must have ready:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Application for Employment<\/li><li>Motor Vehicle Report<\/li><li>Certificate of Road Test<\/li><li>Medical Examination Report<\/li><li>Medical Examiner\u2019s National<\/li><li>Registry Verification<\/li><li>Skill Performance Evaluation<\/li><li>Certificate Application<\/li><li>Record of previous employers contacted<\/li><li>Driver\u2019s written authorization to release\ninformation<\/li><li>Electronic\/Paper logs\/Time records<\/li><li>Complete Driver\u2019s Daily Vehicle<\/li><li>Inspection Reports<\/li><li>Periodic\/Annual DOT Inspection Reports<\/li><li>Drug and Alcohol program certificate<\/li><li>Pre-employment drug test results<\/li><li>Random Drug and Alcohol Test results<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Are you audit ready? Although many carriers believe that\nthey\u2019re operating compliantly, as we already showed, the numbers tell a\ndifferent story. In today\u2019s blog post, you\u2019ll learn about the most common\nreasons that carriers received a violation this year, as well as what you can\ndo to try and prevent the violations at hand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although this is by no means a comprehensive list of\ncompliance issues, ensuring your company and drivers comply with the\nregulations outlined on the following pages will go a long way towards helping\nyou avoid violations now and in the future.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Want to know what the most common violations of 2019 have\nbeen so far?<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>383.37A Allowing Driver to Operate with a\nSuspended\/Revoked\/Etc. These regulations are in place to\nprotect the safety of the roadways by ensuring that all commercial motor\nvehicle drivers are properly licensed and have the knowledge and skills\nrequired of the job.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It probably goes without saying that a driver must have a\nvalid license to operate a motor vehicle on public roadways. As the data shows,\nhowever, that doesn\u2019t mean that drivers are always compliant with this law. In\nfact, it\u2019s one of the most common reasons for a violation, accounting for 34\npercent of acute violations in 2019 so far.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not only does operating with a suspended or revoked CDL\nresult in an automatic out-of-service order, but it can result in hefty fines\nfor the motor carrier, as well. According to an analysis of closed enforcement\ncases for 2019, the average amount settled for cases involving a violation of\n383.37(a) was $8,951.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Part 383 of the federal regulations states that \u201cNo person\nwho operates a commercial motor vehicle shall at any time have more than one\ndriver\u2019s license.\u201d Although states are supposed to perform a check to ensure\nthat a driver doesn\u2019t have a CDL in another state prior to granting a driver\u2019s\nlicense, the system isn\u2019t perfect and drivers are sometimes able to secure a\nsecond, valid CDL. It happens frequently enough, that it was the fourth most\ncommon violation in 2019. The cost to motor carriers for drivers caught driving\nwith multiple CDLs is $8,047 per case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The third most common violation in Part 383 is driving a\ncommercial motor vehicle while being disqualified from holding a CDL. The\nreason for disqualification may include a driver who was under the influence of\nalcohol or a controlled substance, leaving the scene of an accident, using the\nvehicle to commit a felony, or making improper or erratic traffic lane changes.\nAccording to 2019 closed enforcement case data, the average fine amount for\ncarriers who were found to have employed a driver who was disqualified from\nholding a CDL was $7,264. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Keys to Prevent Violations<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The best way to ensure that your company complies with all areas of regulation Part 383 is to use third-party software that runs the following background checks. Keep in mind that because the following screens are consumer reports, they do need to be run by a third-party administrator. There are plenty of companies and vendors who offer this kind of software and support. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">                                                         <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The best way to ensure that one of your drivers isn\u2019t\noperating with a revoked or suspended CDL is to continuously monitor their\nmotor vehicle reports. Otherwise, you\u2019ll only get annual updates during the\nyearly MVR review, which could enable drivers to operate illegally for many\nmonths before you find out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An MVR Monitoring program will monitor your drivers\u2019 motor\nvehicle reports and alert you as soon as a change is detected. This ensures\nthat you know immediately if a driver\u2019s license is suspended, they receive a\nspeeding ticket, or they are involved in a motor vehicle accident. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A search of the Commercial Driver\u2019s License Information System\n(CDLIS) will provide important information about a driver\u2019s current license\nstatus, as well as any additional licenses they\u2019ve held in the past. It\u2019s the\nbest way to verify whether a driver has multiple CDLs before you let them on\nthe road for your company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are few sections of the FMCSA regulation book that are as complex as those related to drug and alcohol testing requirements. Perhaps it\u2019s no surprise, then, that many of the top audit violations had to do with problems in this area. Part 382 of the federal regulations lay out the testing process for motor carriers, including what tests are required, how tests should be performed and what substances drivers are prohibited from using.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">                                                         <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fortunately, we are going to cover how to prevent section\n382 violations in Part II of our series.
