If there are injuries, major vehicle damage,\nor a toxic spill, call 911. If the collision is minor, your truck driver should\nexchange insurance and contact information with the other party. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Complete contact information, and an accurate description of\nthe time, date, and circumstances of the collision will help expedite\ninvestigations and may help your insurance company minimize claims costs. Do not\ndiscuss further incident details with the other party at the scene. If the vehicle is not paid o\ufb00, the business must\ncontinue making payments on the vehicle while it\u2019s out of service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If your driver did everything right when faced with an\nunavoidable collision, this is a great opportunity for positive recognition.\nConsider rewarding your driver with an incentive or company-wide recognition. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If, on the other hand, the driver was at fault, consider\nwhether corrective action needs to be taken. Be mindful of your company\u2019s\nsafety and discipline policies when taking action and consider seeking legal\ncounsel for guidance. Appropriate safety and discipline policies can help\ndemonstrate your company\u2019s commitment to safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Audits and Expenses<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Either way it goes, get prepared for a premium hike\nFollowing an incident, insurance rates may increase, or your insurance provider\nmay drop your company altogether. Comply with FMCSA audit, if applicable. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FMCSA may conduct an audit to determine if your company\nhas violated safety regulations. Penalties assigned by the FMCSA could include\nfees, temporarily halting company operations, or even shutting down the\nbusiness entirely. These \ufb01ndings will impact your Compliance, Safety and\nAccountability (CSA) score, which may negatively impact your ability to attract\nand service customers. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You will also need to manage medical, property, and\nliability claims. If workers\u2019 compensation claims are \ufb01led by your driver, the\nclaims must be processed, investigated, and potentially paid. You may need to\nrecruit another driver to replace your current truck driver if he or she is\ninjured or terminated. Claims and injuries can cost your company valuable\nresources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even more, you need to be prepared to defend against\nthird-party claims. In many states third parties have up to three years or more\nto make claims. This varies depending upon the state. Be sure to retain all\nrelevant records through the duration of this period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And, of course, with defending against third parties also comes being prepared to \ufb01ght a lawsuit. A collision brings the risk of a lawsuit\u2014piling up attorneys\u2019 fees, \ufb01nancial fees, reputation loss, and downtime.
